Rene is free!
Nach zwei Monaten Haft in Warschau entlassen.
Am 11. August um 16.30 Uhr wurde der Berliner Rene K. aus dem Warschauer Untersuchungsgefängnis Bialoleka entlassen. Vorausgegangen war die Zahlung einer Kaution in Höhe von 7500,- Euro an das zuständige Strafgericht. Bis zu einem Prozess gegen ihn, wegen des Angriffs auf Polizeibeamte und wegen Drogenbesitz geringfügiger Mengen, bleibt Rene ab jetzt von der Haft verschont. Durch die neue Situation wird das Verfahren gegen ihn mit geringerer Priorität behandelt und wird voraussichtlich nicht in absehbarer Zeit stattfinden.
Rene war seit dem 10. Juni inhaftiert, nachdem er an der Parada Rownosci, der Parade für sexuelle Gleichberechtigung in Warschau teilgenommen hatte. Ihm wird vorgeworfen auf dem Endkundgebungsplatz bei Auseinandersetzungen mit Gegendemonstranten mittels Schlagstock und Reizgas Polizisten angegriffen zu haben. Rene und einige Zeugen bestreiten dies jedoch.
Wie wenig Substanz die Vorwürfe der polnischen Justiz gegen ihn haben, zeigt seine heutige Freilassung. Der gleiche Antrag auf Haftverschonung wurde bereits vor einem Monat mit der Begründung abgelehnt, Rene hätte keinen Wohnsitz in Polen und die zu erwartende Strafe sei so hoch, dass er sich der Verhandlung entziehen könnte. Kaum, dass unser Kautionsangebot, die übliche Höhe um ein Vielfaches überschritt, ist das plötzlich kein Problem mehr.
Das irgendwann stattfindende Verfahren gegen Rene wird zeigen, dass seine Festnahme und die versuchte Kriminalisierung der ganzen Gleichberechtigungsparade, staatliche Willkürakte sind und der homophoben Einstellung der polnischen Regierung entsprechen. Das Verfahren gegen Rene muss jetzt durchgefochten werden, damit die Willkür der Behörden in Warschau nicht weiterhin Menschen aus der lesbisch/schwulen Community trifft. Für Rene war die Haft in Warschau zwei Monate Vorkosten der strukturellen Gewalt, die Menschen in Polen erleiden müssen, wenn sie ihre Nicht-Heterosexualität öffentlich demonstrieren.
Zeugenaufruf
Liebe Freundinnen und Freunde,
diese Nachricht soll Menschen erreichen, die am 10. Juni 2006 in Warschau an der Parade für Gleichberechtigung teilgenommen haben.
Wir unterstützen den Berliner Rene, der seit der Parade in Warschau in Untersuchungshaft sitzt. Ihm wird vorgeworfen auf dem Endkundgebungsplatz der Parade am 10. Juni 2006 in Warschau gegen 16.50 Uhr, zusammen mit anderen schwarz gekleideten Personen eine Auseinandersetzung mit rechtsextremen Gegendemonstranten gehabt zu haben. Vier Polizisten geben an, Rene hätte sie während dieser Auseinandersetzung mit einem Baseballschläger und Reizgas angegriffen. Obwohl Rene keine waffenähnlichen Gegenstände bei seiner Festnahme dabei hatte und nach eigenen Angaben nicht einmal in der Nähe der Auseinandersetzung war, wird an dieser Version festgehalten und der Haftbefehl so begründet. Das ist der Grund für seine Inhaftierung bis zum Prozess, der vermutlich Mitte August stattfinden wird.
Wir suchen dringend Menschen, die:
- die Auseinandersetzungen mit den Gegendemonstranten auf dem Endkundgebungsplatz beobachtet haben
- die danach stattfindenden Festnahmen gesehen haben
- selbst dort kurzfristig festgenommen wurden
- Film- oder Fotoaufnahmen vom Ende der Parade gemacht haben.
Rene trug zum vermeintlichen Tatzeitpunkt eine schwarze Regenjacke, blaue Jeans, schwarze Turnschuhe, eine Sonnenbrille und einen schwarzen Fischerhut und hatte einen weißen Beutel dabei.

Free Rene! Against the criminalizing of the homosexual community Warsaw and its Equality Parade!
Summer, sunshine and good mood! Gays, lesbians, bisexual and transsexual people celebrate the "Equality Parade" in Warsaw. The parade continues the international tradition of the Christopher Street Day. Therefore the parade is not an embittered demonstration but a swinging and colourful manifestation of self-confidant people who demand for a self-determined sexuality. The dangerous situation for gay and lesbians in Poland and the fact that discrimination and violence are tolerated by the Polish state, as well as the growing resistance of homosexuals in Poland has been picked out as a big issue by the medias world wide. Rene went like many of us and a lot of other Europeans to the Equality Parade in Warsaw on the 10th of June in support of the Polish movement for equality to attend the parade demanding for the right of free love, lust, pleasure, homosexuality and the good life. When the day ended Rene was handcuffed. He has been arrested at the end of the demonstration by the police. As recently as the 11th August he could leave prison on a bail of 7500 Euro.
Constructed reproaches
It was said that Rene took part in a row/quarrel against a group of people which tried to disturb and to attack the parade. Furthermore it was mentioned later on that the reproached changed and Rene has been accused of attacking two policemen with a baton and irritant gas. There is a lack of evidence and independent witnesses for the accusation. The charge is based upon the statements of four policemen who agreed upon the same story to punish him as a representative of the realised parade which has been hated by the government. Rene protests his innocence because he has not even been near to a row and furthermore he affirms that he has not seen an attack on a policeman ,after all. He stood on the Theatre Place and has been attacked suddenly by the police. In addition, the public prosecutor`s office claims that Rene would be not only in jail because of the attack on the policemen but also because of traces of drugs in his clothes. This accuse which is persecuted a little tries to depoliticise his imprisonment and tries to give the case a note of being in accordance with the rule of law.
2 months in prison
Rene had been living those two months under bad conditions in the jail of Warsaw and has been waiting for his trial which is supposed to take place in September. His everyday life was marked by insecurity, isolation and the fear of being attacked by other prisoners or the prisoners guards. German newspapers, books and visits were forbidden and only twice a month he could see his lawyer or a relative. There was no other connection to the world outside the prison and he had to stay 23 hours per day with five other prisoners in the same overheated cell. Because of the bad food he was only able to eat some oatmeal gruel. Fortunately he could raise his reputation by a television and some money.
Rene needs support and solidarity
Protest against his imprisonment was constantly growing in Poland and also in Germany and has lead to his release. There have been protests and demonstrations in front of Polish councils in Berlin, Leipzig, Cologne and Hamburg yet. More of them will follow. We need to continue the protest. Beside some celebreties like Nina Hagen or Thomas Hermanns there are also the WASG and the Linkspartei who demand a proof of evidence by the Ministry of foreign affairs. In Poland the case is watched attentivly by the Helsinki Foundation for Human Rights. This diversity of protest members has lead to his release on bail and must continue and grow for the guarantee of a fair trial and to rise the pressure on the authorities in Warsaw. Be proactive and inventive: Write protest letters and demand for the dismissal, organize protests, collect money for his lawyer, produce publicity to show that we wont let Rene alone! Call for witness reports
Dear friends,
this call is intended to reach people who participated at the Warsaw Parade for Equality, which took place on June 10, 2006.
We’re supporting René from Berlin who is in detention while awaiting trial since the parade. He is accused of being involved in an action against right-wing anti-parade-demonstrators together with other people, dressed in black. Four policemen stated afterwards that René attacked them during the struggles with a baseball racket and tear gas. Although René didn’t have any weapon-like item with him, when he was arrested and although he states, that he wasn’t even close to the action, the authorities adhere to this version and use it as an argument for his detention. This is the reason for his detention while awaiting trial, which is scheduled for mid-August.
We are urgently looking for people
- who have observed the struggles with anit-parade-protesters during the closure rally
- who have observed the subsequent detention
- who made photos or video-recordings during the parades’ end
René wear at that time a black rain coat, blue jeans, black sneakers, sunglasses, a black cap and had a white bag with him.
